PACIFIC BLUE TERMS AND CONDITIONS
CANCELLATION
Cancel your reservation within 5 days of arrival and get a full 100% refund – Cancel within 4 days or less and there will be no refund.
OCCUPANCY
Please do not exceed the maximum number of individuals stated in the Reservation
NO SMOKING
Smoking is not allowed on and within any and all portions of the Property. Fireworks are not allowed at the Property. Fires are a very real danger in our forests so please be very careful.
GARBAGE
Property bag garbage, place in cans and keep covered to avoid wild animals. Garbage collection is on a regular weekly schedule. Please take note of your rental garbage schedule and leave cans by the street.
USING ITEMS
Guest is responsible for operating the items and systems found in the home and Pacific Blue cannot guarantee that every item requested is available and in working order. We will make every effort to assure the home and all equipment is operational prior to your arrival, but in the event that an item or system is not working, no refunds will be given.
USE OF PREMESIS
Guest shall use the premises only in a lawful manner. The Premises shall be used for a private residential vacation rental by the persons comprising the Guest party. Guest shall not permit other individuals to reside in the Premises or to treat the Premises as a residence. Guest shall not misuse or neglect the Premises. Guest shall not use the Premises for any commercial or unlawful activity.
CHECK – IN
Check-in time is 4:00 pm. Guest cannot access the premises prior to 4:00 pm without prior written approval and payment for early check-in.
CHECK – OUT
Check-out is no later than 10:00 am. As such, the premises must be vacated of people and belongings by this time or earlier.
TRAILERS TENTS & RV’s
Using trailers, tents or RV’s for living space or sleeping is not allowed on this property at any time.
BE RESPECTFUL & NEIGHBORLY
The Rental Party shall govern themselves in a civilized, respectful manner and shall be good neighbors respecting the rights of the surrounding property owners. The Rental Party shall not be noisy or loud and likely to disturb or annoy the surrounding property owners. Any outdoor noise should be kept to a minimum.
PET’S
Pets are welcome at some but not all of our properties and non-refundable pet deposit of $75.00 per pet will be required as is our policy if you are bringing a pet with you.
HOT TUBS
No children under the age of sixteen (16) are permitted in the pool or hot tub without direct adult supervision. When using the pool or hot tub, Guest acknowledges that there is a certain health risk associated with the use of such facilities and Guest fully accepts such risks. Guest agrees that all members of the Rental Party shall use the same at their own risk.
ADDITIONAL CHARGES
Guest agrees to accept any charges for any additional fees incurred during the guests stay.
TAKE CARE & BE RESPECTFUL OF THE HOME
Please be respectful in regards to people and property, such as the house, land, amenities, furnishings, neighbors and surrounding area.
INDEMNIFICATION & LIABILITY
Owner and Agent shall not be liable for any damage or injury to Guest or to any other person or to any property, occurring on or within any portion of the Premises. Guest acknowledges that the Premises is subject to certain inherent dangers, such as its proximity to a body of water, the existence of a water fountain, rocks, fire pits and fireplaces. Guest agrees to defend and hold Owner and Agent harmless, and to indemnify Owner and Agent from any claims for damages or injuries caused by Guest, the Rental Party and/or other occupants, visitors or other individuals.
ATTORNEY FEES
Owner and Agent shall be entitled to recover any costs and/or attorney fees incurred in enforcing the terms of this agreement.
Pacific Blue SMS Messaging Program
Our SMS Messaging Program provides you with information and messages from Pacific Blue Vacation Rentals, Inc. (“Pacific Blue”) through SMS (text messages). If you opt-in to the program, you will receive SMS text messages with information from Pacific Blue vacation Rentals. NOTE: Msg & Data Rates May Apply. You can opt-out at any time (see opt-in/out section below).
Your Consent. You understand and agree:
1.Pacific Blue will send you text messages, information, and marketing content or advertisements via the mobile telephone number you used to opt-in. You agree that Pacific Blue may send the messages using any method, including automated dialing technology.
2.You are not required to enter this agreement as a condition of purchasing any property, goods, or services.
3.You are over the age of 18 and you are authorized to enter into this agreement.
4.You have entered the mobile telephone number correctly and that you are the owner or authorized user of the number provided.
5.You will contact us to let us know (within 48 hours) if your phone number changes or is reassigned.
6.You understand that your mobile carrier’s messaging and data rates may apply.
How to Opt-In and Opt-Out
1.Pacific Blue will provide opportunities for you to opt-in to the program by texting a request to a Pacific Blue number, providing your phone number to a website, or by some other method. When you opt-in you will receive an initial text message requesting confirmation of your choice to opt-in and asking for an affirmative reply.
2.You can opt-out of the program at any time using one of these methods:
– Reply to Pacific Blue with the word STOP. You will receive one return message confirming you have been opted-out.
– Contact Pacific Blue via email at [email protected]. We request that you use the subject line “SMS Opt-Out.” You must include your mobile phone number. You will receive a return email confirming you have opted-out.
Other Terms and Conditions
1. By opting-in to Pacific Blue messages or by using Pacific Blue’s website or services, you agree to be bound by the Pacific Blue Privacy Policy and Terms of Use.
VIOLATIONS OF TERMS & CONDITIONS
Any violation of the Pacific Blue terms listed above may result in a forfeiture of your rights regarding this rental property, including eviction from the premises without refund.
